    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

    • Disclosure for a business purpose: shared with our processor Shopify
    • Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, Paypal, and other accepted payment methods), email address, and phone number.

Mobile Terms of Service

The Shop D.Design mobile message service (the "Service") is operated by D.Design (“Shop D.Design”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Shop D.Design's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Shop D.Design through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Shop D.Design. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18558566794 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Shop D.Design mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

    Using Personal Information

    We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

      Retention

      When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

      Automatic decision-making

      If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

      We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

      Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

      Services that include elements of automated decision-making include:

      • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
      • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

      Selling Personal Information

      California state residents may be entitled to certain privacy and consumer rights under the California Consumer Privacy Act (CCPA) or other applicable laws. The following are the rights available if you are a California state resident.

       

      Right to DeleteYou have the right to request that Company delete any personal information about you which the Company has collected from you. Company will fulfill this request free of charge within 45 days. As per applicable laws, we may extend this response period by an additional 45 days, and in case of such an extension we will notify you. Notwithstanding your right to delete your personal information, Company reserves the right to retain any of your personal information that it is permitted or required to maintain pursuant to applicable laws.

      Right to AccessYou have the right to request that Company provide you the following information:

      • The categories and specific pieces of personal information Company has collected about you.

      Right to Opt-Out or “Do Not Sell or Share My Personal Information”

      Company does not sell or share your personal information with any third party not affiliated with Company. California law requires applicable businesses to identify, for a 12-month period prior to the date of this Policy, what information Company has sold about you. If applicable, as a California resident, you have the right to opt-out of or request Company to cease any sale or sharing of your personal information to third parties.
